Acknowledgement of Risks Inherent in Participating in Event

I, the undersigned, agree, acknowledge, and understand that LOST CREEK RANCH, LLC, a Delaware limited liability company, and its principals CATHERINE and JOHN GIESECKE, have invited me and granted me permission to come upon ranch property owned by said Company in Sweet Grass County, Montana, to engage in a private, non-commercial social function and to participate in certain voluntary, outdoor recreational activities in connection with such function, such as by way of illustration but not limitation, orienteering, hiking and driving/riding All-Terrain Vehicles, and, in consideration for such permissive use, and to the fullest extent possible under applicable law, I hereby forever release, indemnify, and hold harmless Lost Creek Ranch, LLC together with its managers, officers, directors, members, agents, and employees, and Catherine and John Giesecke, in their individual capacities, from any and all claims, demands, suits, causes of action, or liability for damage to property or personal injury to myself and/or my spouse, which may result from my engagement in these outdoor recreational activities on said ranch property, and from the inherent risks incident thereto, known or unknown, foreseen or unforeseen.

I acknowledge that outdoor recreational activity can be inherently dangerous and that it includes risk of injury or property damage from the conditions, natural or otherwise, existing on the property, from the weather and elements, from wild animals or livestock, from the use of off-road vehicles, and or from the intentional or negligent acts or omissions of third persons. I further understand and acknowledge that neither Lost Creek Ranch, LLC nor any of its managers, officers, directors, members, agents, and employees, nor Catherine and John Giesecke are responsible for my safety while I am on the property.

I agree to follow all written and or verbal rules and or guidelines given by Lost Creek Ranch, LLC and or Catherine and John Giesecke regarding my participation in such outdoor recreational activity on the ranch property.

I represent and warrant to Lost Creek Ranch, LLC, and to Catherine and John Giesecke individually, that I am of normal physical ability and in good health, that I will not engage in any outdoor recreational activities under the influence of alcohol or any other controlled or illegal substance, that I am knowledgeable and experienced in the operation of any vehicles or equipment that I may be permitted to, and choose to, utilize on the LLC’s ranch property, and that my participation in such activities is purely voluntary.
